Illinois Family Law Services

Our attorneys work with clients on matters including, but not limited to, the following…

Divorce

We are here to fight for you and your interests in the courtroom, during settlement negotiations, and through every twist and turn throughout your case. Our Trial Attorneys have handled thousands of cases over the last 40 years, including cases in the Illinois Appellate Court. Our team can litigate any issue that may arise during your divorce: maintenance, taxes, high-net-worth division of assets; division of debts, property division, business interests, marital and non-marital property, dividing retirement accounts and preparing QDROs, dissipation of assets, contempt actions, Orders of Protection and domestic violence, and modifications to prior court orders.

Child Support

With recent changes to Illinois law regarding child support, the financial responsibilities of each parent during a divorce or parentage matter is examined. The income-shares model considers parenting time and parenting responsibilities, as well as income and/or earning capacity. In addition to child support, we will handle all questions regarding your children’s financial needs including health insurance premiums and medical expenses, educational expenses and college tuition, extracurricular activities, and more.

Paternity

Paternity matters include issues of child support and parenting responsibilities for unmarried parents. In Illinois, paternity must be first be established by the Court in order for child support and parenting time to be determined. Our lawyers will work with you through the process to legally establish paternity and define the responsibilities of each parent.

Divorce Modification

Life comes at us fast and circumstances can change after a divorce settlement is reached or a Judgment is entered. If the changed circumstances are substantial enough, a court may approve a modification to aspects of the Judgment that are no longer practical for your family. Call Tameling & Associates, P.C. to schedule a consultation to discuss your specific situation and we can advise you on the merits of your individual case.

Child Custody, Visitation, and Parenting Time

When parents separate, there are several decisions that have to be made regarding children. This is often the most contested and emotional aspect of a case. We are knowledgeable and experienced in the unique parenting issues that may arise during a divorce or parentage case. We have worked with Guardian ad Litems and Child Representatives in courtrooms all across the Chicagoland area, and we are prepared to fight for your rights and the best interests of your children. Our experienced Trial Attorneys have litigated thousands of cases and will represent you every step of the way. Our attorneys are also approved Guardian ad Litems in DuPage County where we represent children as an officer of the Court, appointed by the Judge, to make recommendations on parenting matters and testify during trial if necessary.

In Illinois, we recently began referring to custody and visitation as Parenting Time and Parenting Responsibilities. We have extensive experience in drafting Parenting Allocation Agreements setting forth specific schedules for weekends, Holidays, vacations, and more. We handle issues relating to relocation and removal when a parent lives or is planning to live out of state. We have experience handling cases where there is a concern about parental alienation, abuse or neglect, or substance abuse. Our attorneys are compassionate and sensitive to these difficult situations.

There are also unique situations involving children that do not occur during a divorce or parentage case. For example, custody can be established by a third party caregiver when the biological parents are unable to physically care for a child. A new spouse can request to adopt a child from their partner’s prior relationship. We will strive to do what is best for your children and your family.

Schedule a consultation with Tameling & Associates, P.C. at our Oak Brook office to discuss your case and your legal rights in these and other unique parenting situations.

Pre & Post Marital Agreements

Prenuptial and Post-nuptial Agreements are some ways that couples that prepare for the possibility that a relationship may end. Prenuptial Agreements occur before a couple is married and can address current financial situations or issues involving children or assets from a prior relationship. Our attorneys can prepare the documents on your behalf, or we can provide representation for you if your partner has already presented a proposed Agreement to you.

Post-nuptial Agreements occur after the marriage has begun and can address concerns with substance abuse, infidelity, or financial matters. Our attorneys will meet with you to discuss what can be included in a Post-Nuptial Agreement and can draft all the necessary documents on your behalf to make it a binding contract.
